La question des rapports du spinozisme à l’axiologie a fait l’objet de nombreux débats. Certains commentateurs considèrent Spinoza comme étant profondément immoraliste, alors que pour d’autres, il maintient l'ensemble des valeurs humaines. Spinoza a cherché à dépasser l’utilitarisme propre au conatus de chacun, afin de fonder un altruisme rationnel. Il souligne que le bien auquel l’homme aspire lorsqu’il suit la vertu, il le désirera aussi pour tous les autres hommes. Cependant, les moyens mis en œuvre pour démontrer cette thèse semblent (...) problématiques. Cet article analyse la logique de la coopération interhumaine élaborée par Spinoza, ainsi que son idéal de l’homme libre, montrant, qu'en fait, il n'a pas réussi à surmonter la nature profondément égoïste du conatus. -/- The question of the relationship between Spinozism and axiology has been the subject of much debate. Some commentators consider Spinoza to be profoundly immoralist, while for others he upholds the set of human values. Spinoza sought to go beyond the utilitarianism proper to the conatus of each person, in order to establish a rational altruism. He emphasizes that the good to which man aspires when he follows virtue, he will also desire for all other men. However, the means used to demonstrate this thesis seem problematic. Ce dernier, pour raisons professionnelles, n'avait indiqué son nom que dans cette partie intitulée "Esquisse d'une psychanalyse scientifique" (allusion respectueuse au titre de Freud "Esquisse d'une psychologie scientifique"), où se trouve expliquée en détail la méthode originale d'analyse de discours inventée et enseignée par lui : l'Analyse des Logiques Subjectives© (A.L.S.©).

Pascal Engel défend explicitement le purisme (ou l’intellectualisme). Selon la version générale de cette thèse, les facteurs qui déterminent si une croyance est justifiée, ou si elle est une connaissance, ne concernent que la vérité. Ils sont totalement indépendants des désirs ou des préférences du sujet, ainsi que des conséquences pratiques potentielles du fait de posséder ces croyances. Dans son article « Pragmatic Encroachment and Epistemic Value » (2009), P. Engel concède que des facteurs pratiques peuvent déterminer la quantité de (...) données (ou la justification) dont on a besoin pour savoir ou croire, tout en maintenant que cela n’affecte pas le purisme épistémique (dans sa version évidentialiste) sur les notions de donnée ou de degré de justification. Mais cela ne revient-il pas tout simplement à concéder l’impurisme épistémique au moins à propos de la connaissance ou de la justification simpliciter des croyances ? Dans cet article, j’examine en détails la position de P. Engel. Je montre que, correctement comprise, elle est intégralement puriste. En considérant le principe connaissance-action, je soulève néanmoins un dilemme pour son approche, jetant ainsi un doute sur le potentiel qu’elle aurait à fournir une réponse puriste satisfaisante à l’argument fondamental motivant l’impurisme épistémique. La plupart des études psychosociologiques et des travaux psychanalytiques sur la psychologie sociale admettent l'existence des groupes et des individus, que leurs rapports soient pensés sur un mode idéologique ou analogique comme dans Totem et tabou par exemple (1). Cette existence, qui paraît aller de soi, nous semble être à préciser, sinon à discuter. (1) Voici l'hypothèse de Freud : "Il n'a sans doute échappé à personne que nous postulons l'existence d'une âme collective dans laquelle s'accomplissent les mêmes processus que (...) ceux ayant leur siège dans l'âme humaine" (S.Freud 1912, 1970, Payot). Une phrase critique de Jacques Lacan, écrite à propos de la dissolution de l'École Freudienne, va nous servir de fil conducteur pour commenter les trois termes qui figurent dans notre titre : "Le groupe se définit d'être une unité synchrone dont les éléments sont les individus. The Italian philosopher Augusto Del Noce (1910-1989) gave an original interpretation of the modern secular age. In this paper, I analyze the reasons why Del Noce saw in Descartes and in Rousseau two fundamental expressions of secularization: according to the two French philosophers, the human being is characterized by an original goodness (status naturae purae). Del Noce noted that this anthropological optimism, widespread in modernity, made superfluous the Christian faith: without the presence of original sin (an evil in human nature), (...) the redemption is no longer necessary. In the last part of the paper it is examined “the Rousseau problem”, i.e. the constitutive ambiguity of the Genevan thinker. Rightly Del Noce pointed out that Rousseau was, at the same time, a religious and revolutionary philosopher: on the one hand, Rousseau criticized modern rationalists and reevaluated the sphere of human feelings (including religious feelings), but on the other, he theorized a revolutionary and Jacobin thought. Therefore, Rousseau can be interpreted as a philosopher who emblematically expressed the ambiguities of the modern process of secularization. (shrink)

It shows first that the key to understand the debate between Benveniste and Derrida over Aristotle’s categories is to be found in the Neoplatonic exegesis of the work of the same name. On considère souvent, à la suite des ouvrages classiques de J. Bouveresse, que Wittgenstein veut opérer un rejet ou une critique de la subjectivité. Il semble cependant que les derniers textes de Wittgenstein consacrés à la philosophie de la psychologie permettent de modifier partiellement ce point de vue, et défaire place à une conception spécifique de la subjectivité, redéfinissant un sujet dépsychologisé voire désubjectivé, qui n'est plus le point sans étendue du Tractatus, ni le sujet métaphysique, ni le sujet de (...) la psychologie, mais simplement une voix ordinaire. Wittgenstein's later work is often held by critics in France, following e.g. Jacques Bouveresse's insights, to be operating a criticism of both interiority and subjectivity. A reading of Wittgenstein's later writings on the philosophy of psychology might somehow change such a point of view, and redefine a specific view — as a de-psychologized species — of subjectivity in Wittgenstein's writing, thus redefining the wittgensteinian subject in terms of an ordinary voice. Self destruction, inapprehensible an option as it might be, has been a challenging issue for philosophers and scholars since the dawn of time, forcing meditation into a vigorous and everlasting debate. The core question is: could suicide ever be deemed rational a choice? And if so, could it count as a moral alternative, if the circumstances call for it? The Stoics from Zeno up to Epictetus and Seneca regarded suicide as the ultimate resort, as the utmost opportunity for a rational (...) being to maintain his virtue, when all other bridges are burnt. For an act to be moral, it has to be deliberate, as well as the manifestation of an established evaluative hierarchy, however spontaneous and instantaneous might the latter be. In other words, a moral act is one that agents rationally opt for over other possible alternatives, on the subjective basis of their alleged best interests. Modern philosophers as Tom Beauchamp, Margaret Battin and Jacques Choron stress the criterion of rationality as a key issue regarding the ethics of suicide. Utilizing Rorty’s second definition of rationality, the article examines whether self destruction can be the outcome of proper evaluative assessment and deliberation, given that, as T. N. Pelegrinis suggests, such an evaluation seems to rest on a symmetry case, which might hardly be based on sound foundation. (shrink)

Aucun autre texte de ce corpus n’a poussé aussi loin le lien entre le corps humain en tant que microcosme et le cosmos, son macrocosme. Ce lien se manifeste notamment dans de multiples analogies, dans des expressions communes utilisées pour les décrire, ainsi que dans des explications identiques des phénomènes qui les caractérisent. Le présent article enquêtera sur une expression spécifique liant l’homme et le (...) cosmos : le terme περίοδος. Dans la continuité des travaux de Luc Brisson et Jacques Jouanna qui ont signalé plusieurs traits communs au Timée de Platon et au traité Du Régime, il s’agira de mettre en lumière l’importance du terme περίοδος, du concept de rotation/révolution, dans l’association microcosme-macrocosme, autant d’un point de vue structurel que fonctionnel. O ensino da Sociologia no Ensino Médio, ao considerar as indicações dos Parâmetros Curriculares Nacionais (PCN), tem como objetivo introduzir o aluno nos principais saberes referentes às questões conceituais e metodológicas que fundamentam a Sociologia, a Antropologia e a Ciência Política2 O contexto de transformação social inaugurado nos séculos XVIII e XIX e a busca pela compreensão científica deste processo vieram estruturar as grandes questões que permeiam este campo do saber. Os paradigmas fundantes da Sociologia, em seus esforços de interpretar (...) o curso das transformações sociais advindas das revoluções industriais e político-sociais, são, portanto, produtos culturais deste processo. Radicado, sobretudo, na busca por estruturar um saber que pudesse oferecer respostas conscientes para dotar a práxis de um sentido capaz de se impor sobre as questões da nova dinâmica social, o campo do conhecimento sociológico, ao chegar às escolas do século XXI, deve ser capaz de promover a reflexão sobre suas próprias bases operacionais. Isso significa que seus parâmetros teóricos e metodológicos fundantes necessitam ser postos a prova constantemente, sendo confrontados com a complexidade do mundo atual. A tradição da Sociologia jamais negou a importância de seu desenvolvimento enquanto ciência crítica de si mesma. Devido a este incessante processo de autocrítica, a reflexão sociológica avalia constantemente de que modo as questões colocadas pelas teorias fundantes de seu saber – as chamadas sociologias clássicas – se comportam diante de um mundo em constante transformação. A inserção da Sociologia como disciplina na grade curricular do Ensino Médio – que veio a realizar-se a partir do Parecer 38/2006, que alterou as Diretrizes Curriculares Nacionais do Ensino Médio tornando a Filosofia e a Sociologia disciplinas obrigatórias, o que efetivou-se com a Lei nº 11 684/08 – vai ao encontro dos objetivos das mudanças propostas pela Lei de Diretrizes e Bases da Educação Nacional (LDBEN) de 1996. Tais mudanças procuraram vincular os pilares do Ensino Médio ao mundo do trabalho e à prática social e objetivaram orientar o papel da educação para capacitar o aprendizado contínuo e autônomo e para o exercício da cidadania. Tais reformas, inclusive, atenderam as propostas da Unesco, que visavam estrutrar a educação em torno de quatro princípios: aprender a conhecer, aprender a fazer, aprender a conviver e aprender a ser.3 Ao postular que as atribuições básicas do conhecimento sociológico são a investigação, a identificação, a descrição e a interpretação/explicação de todos os fatos relacionados à vida social, os PCN enfatizam o papel desse saber para proporcionar ao aluno os instrumentos necessários para decodificar a complexidade da realidade social. Assim, a Sociologia se apresenta, na grade curricular do Ensino Médio, como instrumento necessário à construção da cidadania. Tal compreensão fortalece os laços da Sociologia com as finalidades do Ensino Médio, defnidas pelas mudanças da LDB, sendo respaldada especialmente pela Lei 9 394/96, que estabelece como meta da educação a construção da cidadania. O ensino da Sociologia, desta forma, ocupa relevan-te papel na construção de uma consciência crítica e reflexiva diante das questões do mundo contemporâneo. Rompendo com as barreiras do senso comum, espera-se que o conjunto sistematizado do conhecimento próprio da Sociologia forneça um aparato teórico que torne o estudante capaz de compreender a dinâmica e as contradições da sociedade em que vive. Voltada à realização do exercício pleno da cidadania, a Sociologia esclarece que a construção de uma sociedade mais justa e solidária é tarefa que exige tanto compreender a complexidade social como as formas de responder e agir em sociedade. Para alcançar esse objetivo em sala de aula, segundo as Orientações Curriculares para o Ensino Médio – Conhecimentos de Sociologia4 , o ensino da Sociologia deve se basear em dois princípios epistemológicos fundamentais: estranhamento e desnaturalização. O estranhamento é posto como uma forma de duvidar, que a nada outorga normalidade e nem se conforma diante dos fatos, exercício necessário à problematização dos fenômenos sociais. No momento em que nada se torna óbvio, nem pressuposto, nem simplesmente aceito, se abre o caminho para o educando romper com as amarras do senso comum e construir uma reflexão sistematizada da realidade. Já o momento de desnaturalização é aquele que procura romper com toda e qualquer forma de compreensão das relações sociais como “imutáveis no tempo e no espaço”. Os fenômenos sociais que vivenciamos no presente são, em geral, apreendidos pelo senso comum como simplesmente preestabelecidos, causando o entendimento de uma origem natural das relações sociais. Cabe ao ensino da Sociologia superar esse entendimento e promover a dessacralização e a desnaturalização da realidade, rompendo com seu imediatismo ao submetê- la a critérios científicos de análise. Desta forma, seja qual for o conteúdo trabalhado pela Sociologia, a Antropologia e a Ciência Política, mais do que oferecer um conhecimento dos fatos, o que se privilegia é o desenvolvimento das perspectivas sociológicas, antropológicas e políticas; a história e o contexto de suas produções e as relações estabelecidas com as realidades que contemplam e com as quais dialogam continuamente. A contribuição das Ciências Sociais reside, pois, justamente na formação humana, ao promover constantemente a problematização da realidade, sempre confrontada pelo olhar inquieto e crítico, não apenas do que se encontra ao redor, mas de si próprio e de sua própria perspectiva. Les pensées de la différence selon Gilles Deleuze et Jacques Derrida se touchent dans leur sujet même, le Sujet qui « fait des histoires et des scènes » construisant le même système différentiel, le monde. C’est ce qui assure une sorte de continuité entre les deux philosophies. Concernant les « thèses » il n’y a aucune différence entre Deleuze et Derrida. Et pourtant, ils ne se laissent pas unir dans une seule et même philosophie de la différence. Les deux (...) histoires ne se laissent pas identifier dans un seul et même discours, elles exigent deux discours différents. Leur Sujet se raconte de deux façons, se joue sur deux scènes parallèlement, alternativement – cela relève d’une différence minime, différence de genre, de style, de geste, qui pourtant change tout. Penser pour Deleuze consiste à entrer dans le jeu, dans l’acte de la différence, à « faire la différence » – pour Derrida c’est comprendre la différence. Une philosophie comme celle de Derrida suspend les philosophies comme celle de Deleuze – une philosophie comme celle de Deleuze ne prend pas au sérieux une philosophie comme celle de Derrida. Leurs pensées s’excluent réciproquement tout en faisant signe l’une vers l’autre - comme le dirait Derrida : selon un certain graphique de la supplémentarité. Renverser le platonisme : changer son ontologie « en hauteur » pour une ontologie « en profondeur » , c’est un jeu immanent de l’ontologie. Le renversement deleuzien du platonisme est de se déplacer insidieusement en lui, mais aussi de se décaler légèrement par rapport à lui, lui ouvrir la porte, y instaurer une autre série de pensée divergente, constituer un para-platonisme, en d’autres mots : le déconstruire. L’effet en sera, selon Foucault, un « Theatrum Philosophicum » de fantasmes, de simulacres, d’événements, d’effets corporels où Freud et Artaud entrent en résonance même en s’ignorant. Derrida joue un tout petit peu différemment, du dehors, ou plutôt à la limite de son dehors. Si on se sert de l’allégorie de Rodolphe Gasché : Derrida s’installe au bord de la réflexion, dans le tain du miroir – on peut dire alors que Deleuze se déplace dans le miroitement, entre les images reflétées. Ils tiennent tous les deux, chacun à leur manière, à la limite de la réflexion, limites internes et externes. L’exemplarité de la relation Deleuze/Derrida réside en ceci : c’est une image de la doublure en soi de la pensée qui tente ses limites. Elle « illustre » la doublure inévitable de la pensée – doublure qui, par ailleurs, appelle à la déconstruction et à son mimétisme. (shrink)

Düşünmeye 'dışarıdan' yani dünyadan başlamak insani (kurgusal) bir dünyaya değil, içinde yaşadığımız gerçek dünyaya inanmak demektir. İçkinliğin politik anlamı düşünceyi dünyaya getirmektir.

Skeptical theists are seeking for some reasonable solutions to the evidential problem of evil. One of the most fundamental responses of skeptical theism is that the concept of “gratuitous evil”, which cannot be a proof of the absence of God. Therefore, it is not the existence of God that skeptical theism suspects. Instead, skeptical theism contemplates whether the evil in the world really has a “gratuitous” basis. This paper focuses on Peter van Inwagen's “no-minimum claim”. No-minimum claim” stands in opposition (...) to the views that assume that God minimizes the evils that exist in the world in order to achieve justice. “No-minimum claim” acknowledges that these evils still have enormous amounts to people. Thus “no-minimum claim” suggests that the evils experienced in the world are incompatible with the “best of all possible worlds” views or the other explanations of classical theodicy. According to the “no minimum claim”, the reason why the amount of evil in the world still seems so high may be God’s deliberate calculations in effecting the distribution of these evils. In order to reach these calculations, it is not necessary for the amount of evil that God allowed to reflect on the world to be perfectly manifested at the minimum level. The purpose of this paper is to consider the skeptical theism approach within the framework of Peter van Inwagen's “no-minimum claim” and to limit his arguments to an alternative approach to skeptic theism. Our claim is that such view coincides with skeptical theism, but the “no- minimum claim” still has some ambiguities at the point of the limits of evil. From this, we can conclude that the “no minimum claim” has received many objections in the skeptical theism literature and these objections are justified at certain points. (shrink)

This chapter engages with Roger Cotterrell's characterisation of the trust as 'ideological.' However, rather than agreeing with Cotterrell that the trust disguises the true ownership of the beneficiary, it shows that the family trust subverts this idea of a one-sided ownership relation altogether by effecting a reversal in the hierarchical distinction between persons and things. Under the appearance of wealth, beneficial owners are serving the very things they own by ensuring their protection and continuous reproduction.

The aim of this article is to bring to light some of the factors that allowed the emergence of secularization, and to understand to what extent and in what ways these factors contributed to the formation of the main lines of Spinozism. I will first examine the issues of secularization, emphasizing the importance of the transformations in the status of the Hebrew language during the Renaissance. I will then analyze the role that the Tractatus theologico-politicus may have had in European (...) culture. Finally, I will clarify Spinoza’s relationship to deism and atheism, specifying the nature of the controversies related to his religious attitude. (shrink)

The question of Spinozist determinism and necessitarianism have been extensively studied by commentators, while the relationship between the notions of divine will and free will still requires elaborate studies. Our article seeks to contribute to such research, by clarifying the analyses of these questions by authors that Spinoza has confronted: Maimonides, as well as other Jewish philosophers, and Leibniz who criticized Spinozist determinism. We will study the consequences of these analyses on two examples that Spinoza gave to refute free will, (...) namely the dream and the situation of Buridan's ass. -/- Résumé: La question du déterminisme spinoziste et du nécessitarisme a été largement étu-diée par les commentateurs, tandis que la relation entre les notions de volonté divine et de libre arbitre nécessite encore des études plus élaborées. Notre article cherche à contribuer à ces recherches, en clarifiant les analyses de ces questions par des auteurs auxquels Spinoza s’est confronté : Maïmonide, ainsi que d’autres philosophes juifs, et Leibniz qui a lui-même critiqué le déterminisme spinoziste. It is widely held that assertions are partially governed by an epistemic norm. But what is the epistemic condition set out in the norm? Is it knowledge, truth, belief, or something else? In this paper, I defend a view similar to that of Stanley (2008), according to which the relevant epistemic condition is epistemic certainty, where epistemic certainty (but not knowledge) is context-sensitive. I start by distinguishing epistemic certainty, subjective certainty, and knowledge. Then, I explain why it's much more plausible (...) to think that "certain", rather than "know", is context-sensitive. After that, I respond to an important worry raised by Pritchard, according to which the proposed view is too strong to accommodate our current practice of assertion. I then show that the main linguistic and conversational data advanced in the recent literature in favour of the knowledge condition are best explained by the certainty view. Finally, I offer two principled considerations: the certainty view is the only one compatible with three independently plausible claims and it fits very well with the common thought that knowledge does not entail certainty. Carl Schmitt's notion of nomos is commonly regarded as the international equivalent to the national sovereign's decision on the exception. But can concrete spatial order alone turn a constellation of forces into an international order? This article looks at Schmitt's work The Nomos of the Earth and proposes that it is the process of bracketing war called Hegung which takes the place of the sovereign in the international order Schmitt describes. Beginning from an analysis of nomos, the ordering function of (...) the presocratic concept moira is explored. It is argued that the process of Hegung, like moira, does not just achieve the containment of war, but constitutes the condition of possibility for plural order. (shrink)

Spinoza, le spinozisme et les fondements de la sécularisation est un ouvrage dédié à la mémoire d’Emmanuel Levinas, dont l’auteur a été l’élève durant plusieurs années. Il vise, à travers une analyse d’ordre philosophique, historique, épistémologique et théologique, à mettre au jour les conditions d’émergence interrelatées du spinozisme et de la sécularisation. Pour ce faire, il souligne, entre autres, l’importance des polémiques anti-maimonidiennes, des débats sur les attributs divins, la substance, l’infini, du marranisme et de la Kabbale sur la formation (...) du spinozisme, ainsi que son rapport à la pensée contemporaine. Logic and psychology overlap in judgment, inference and proof. The problems raised by this commonality are notoriously difficult, both from a historical and from a philosophical point of view. Sundholm has for a long time addressed these issues. His beautiful piece of work [A Century of Inference: 1837-1936] begins by summarizing the main difficulty in the usual provocative manner of the author: one can start, he says, by the act of knowledge to go to the object, as the Idealist does; (...) one can also start by the object to go to the act, in the Realist mood; never the two shall meet. He is himself inclined to accept the first perspective as the right one and he has eventually developed an original version of antirealism which starts, not from considerations about the publicity of meaning, in the manner of Dummett, but from an epistemic standpoint, trying to search in a non-Fregean tradition of analysis of judgement and cognate notions a way of founding constructivist semantics. The present paper ploughes the same field. The paper presents the notion of “Spirit of Nature” in Henry More and describes its position within More’s philosophical system. Through a thorough analysis, it tries to show in what respects it can be considered a scientific object and in what respects it cannot. In the second part of this paper, More’s “Spirit of Nature” is compared to Newton’s various attempts at presenting a metaphysical cause of the force of gravity, using the similarities between the two to see this notorious (...) problem of Newton scholarship in a new light. One thus sees that if Newton drew from Stoic and Neo-Platonic theories of aether or soul of the world, we need to fully acknowledge the fact that these substances were traditionally of a non-dualistic, half-corporeal, half-spiritual nature. Both More’s “Spirit of Nature” and Newton’s aether can thus be understood as different attempts at incorporating such a pneumatic theory into the framework of modern physics, as it was then being formed. In this essay Derrida reflects, for the first time at length, on secularization as a historical process. Whereas his earlier writings on religion focus on Jewish and Christian authors who blur the boundaries of religious belonging, this essay directly questions the categories of religion and secularization. Against this background, Derrida revisits the work of Kant, Voltaire, Nietzsche, and Heidegger, and he reflects on his own engagement with messianism, negative theology, and the khôra.

Bolzano was the first to establish an explicit distinction between the deductive methods that allow us to recognise the certainty of a given truth and those that provide its objective ground. His conception of the relation between what we, in this paper, call "subjective consequence", i.e., the relation from epistemic reason to consequence and "objective consequence", i.e., grounding however allows for an interpretation according to which Bolzano advocates an "explicativist" conception of proof: proofs par excellence are those that reflect the (...) objective order of grounding. In this paper, we expose the problems involved by such a conception and argue in favour of a more rigorous demarcation between the ontological and the epistemological concern in the elaboration of a theory of demonstration. A certain number of cases suggest that our willingness to ascribe “knowledge” can be influenced by practical factors. For revisionary proposals, they indicate that the truth‐values of “knowledge” ascriptions vary with practical factors. For conservative proposals, on the contrary, nothing surprising is happening. Standard pragmatic approaches appeal to pragmatic implicatures and psychological approaches to the idea that belief formation is influenced by practical factors. Conservative proposals have not yet offered a fully satisfactory explanation, though. In this article, I introduce and (...) defend a third conservative proposal which I call “Refined Invariantism”. The two main claims of this proposal are that (1) we should distinguish between high stakes cases in which the subject does not believe (that he knows) the target proposition and those in which he believes (that he knows) the target proposition and that (2) we should adopt a psychological treatment for the first kind of case and a pragmatic treatment based on the epistemic standards for appropriate assertion and action for the second kind of case. I argue that this new combined approach avoids the main pitfalls of its two conservative rivals and that it gives new life to the generality objection levelled against revisionary views. (shrink)

Are words like ‘woman’ or ‘man’ sex terms that we use to talk about biological features of individuals? Are they gender terms that we use to talk about non-biological features e.g. social roles? Contextualists answer both questions affirmatively, arguing that these terms concern biological or non-biological features depending on context. I argue that a recent version of contextualism from Jennifer Saul that Esa Diaz-Leon develops doesn't exhibit the right kind of flexibility to capture our theoretical intuitions or moral and political (...) practices concerning our uses of these words. I then float the view that terms like 'woman' or 'man' are polysemous, arguing that it makes better sense of the significance of some forms of criticisms of mainstream gender ideology. (shrink)

What does it mean to act politically? This paper contributes an answer to this question by looking at the role that necessity plays in the political theory of Carl Schmitt. It argues that necessity, whether in the form of existential danger or absolute values, does not affect the sovereign decision, which must be free from normative determinations if it is to be a decision in Schmitt’s sense at all. The paper then provides a reading of Schmitt in line with Weber’s (...) ethics of responsibility, according to which the political actor decides not arbitrarily and irresponsibly, but actively assumes responsibility for the decisions he takes. Within a liberal, ‘law of things’ understanding of property, the donative trust is seen as a species of gift. Control over trust property passes from the hands of settlors to beneficiaries, from owners to owners. Trust property, like all other property, is silent and passive, its fate determined by its owners. This article questions this understanding of the trust by showing how beneath the facade of ownership, the trust inverts the relation between owner and owned, person and thing. It analyses (...) the relation that trustees, beneficiaries and settlors have to the trust property and argues that the role of each of these parties can be shown to consist in furthering the interests of the trust property rather than their own. It claims that this protects things from their owners at the same time as it ensures these owners’ ongoing care towards the things they own. This raises questions about the trust’s status within the institution of private property, justified as it is by the human autonomy it is said to enable. (shrink)

This article aims to shed light on the possible influence of the Kabbalah on Spinoza. To do this, I will analyze the role that the Kabbalist theoretical model may have had on the development of Spinozist philosophy, in order to understand both their convergences and their divergences. I will then clarify Spinoza's relationship to this theory, especially the Lurianic Kabbalah, and emphasize the importance of the notion of Tsimtsum (contraction of the Divine light).

This article takes as its subject matter the juridico-political space of the prisoner of war (POW) camp. It sets out to determine the nature of this space by looking at the experience of war captivity by Jewish members of the Western forces in World War II, focusing on the experience of Emmanuel Levinas, who spent 5 years in German war captivity. On the basis of a historical analysis of the conditions in which Levinas spent his time in captivity, it argues (...) that the POW camp was a space of indifference that was determined by the legal exclusion of prisoners from both war and persecution. Held behind the stage of world events, prisoners were neither able to exercise their legal agency nor released from law into a realm of extra-legal violence. Through a close reading of Levinas’s early concept of the ‘there is’ [il y a], the article seeks to establish the impact on prisoners of prolonged confinement in such a space. It sets out how prisoners’ subjectivity dissolved in the absence of meaningful relations with others and identifies the POW camp as a space in which existence was reduced to indeterminate, impersonal being. This article provides a property analysis of electronic money, showing that the issuance of electronic money cannot involve a trust. The analysis is also applicable to other digital assets that may be said to involve a trust, and as such provides a timely contribution to current discussions on the legal nature and categorisation of digital assets both in the UK and internationally.

Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. Experimental philosophers have gathered impressive evidence for the surprising conclusion that philosophers' intuitions are out of step with those of the folk. As a result, many argue that philosophers' intuitions are unreliable. Focusing on the Knobe Effect, a leading finding of experimental philosophy, we defend traditional philosophy against this conclusion. Our key premise relies on experiments we conducted which indicate that judgments of the folk elicited under higher quality cognitive or epistemic conditions are more likely to resemble those of the (...) philosopher. We end by showing how our experimental findings can help us better understand the Knobe Effect. (shrink)

Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience. A critical survey of various positions on the nature, use, possession, and analysis of normative concepts. We frame our treatment around G.E. Moore’s Open Question Argument, and the ways metaethicists have responded by departing from a Classical Theory of concepts. In addition to the Classical Theory, we discuss synthetic naturalism, noncognitivism (expressivist and inferentialist), prototype theory, network theory, and empirical linguistic approaches. Upon doing something generous for someone with whom you are close, some kind of reciprocity may be appropriate. But it often seems wrong to actually request reciprocity. This chapter explores the wrongness in making these requests, and why they can nevertheless appear appropriate. After considering several explanations for the wrongness at issue (involving, e.g. distinguishing oughts from obligation, the suberogatory, imperfect duties, and gift-giving norms), a novel proposal is advanced. The requests are disrespectful; they express that their agent insufficiently trusts (...) the hearer to recognize their own reasons to reciprocate, and the close relationship between them morally requires this kind of trust. This proposal is articulated and situated in the recent discussion of the normativity of requests. The chapter concludes by explaining how these requests may appear appropriate. Agents in these relationships often have standing to make requests, though the standing is lacking in these particular cases. (shrink)

Standard epistemic logic actually formalizes folk-psychology. The problem of logical omniscience shows that this logic is not adequate in a cognitivist setting. In order to describe realistic information-processing believers, we need both an ontology of particulars and a hyper-intensional taxonomy of representations. From this point of view, sub-structural logics, which do not overlook the syntaxic details of the processing of information, are an interesting alternative to possible worlds semantics.

Many philosophers agree that there is an epistemic norm governing action. However, they disagree on what this norm is. It has been observed that the word ‘know’ is prominent in ordinary epistemic evaluations of actions. Any opponent of the knowledge norm must provide an explanation of this fact. Gerken has recently proposed the most developed explanation. It invokes the hypothesis that, in normal contexts, knowledge-level warrant is frequently necessary and very frequently sufficient (Normal Coincidence), so that knowledge-based assessments would be (...) a good heuristic for practical reasoning and epistemic evaluations of action. In this paper, I raise three problems for this approach. First, I argue that Normal Coincidence is ad hoc: it relies on an unsupported frequency hypothesis that we should expect to be false given the warrant account that Gerken also endorses. Second, I argue that, in any case, Normal Coincidence is insufficient to support the hypothesis that knowledge-based evaluation of action constitutes a good heuristic. Third, I consider three other hypotheses close to Normal Coincidence apparently more likely to support the heuristic hypothesis, but I argue that they seem even more ad hoc than Normal Coincidence. En este artículo abordo críticamente la aseveración de David Papineau según la cual la evidencia fisiológica acumulada es suficiente para adoptar razonablemente el Principio del Cierre Causal de lo Físico y la vía negativa, viz. entender físico como no mental, como solución al dilema de Hempel. Comenzaremos restando fuerza a tal afirmación revisando el trabajo de W. Penfield y J. Eccles, dos importantes neurocientíficos y declarados dualistas. No obstante, luego nos centraremos en el trabajo de B. Libet en el que (...) se demostraría que los movimientos voluntarios están realmente determinados por causas enteramente fisiológicas, lo cual constituiría una pieza fundamental de evidencia a favor de Papineau. Nuestro análisis mostrará que no se siguen tales conclusiones. Esto tendrá consecuencias negativas para el Cierre Causal de lo Físico y con ello para el Argumento Causal para el Fisicalismo del cual el mencionado principio es premisa clave. (shrink)

This study asserts that W.V.O. Quine’s eliminative philosophical gaze into mereological composition affects inevitably his interpretations of composition theories of ontology. To investigate Quine’s property monism from the account of modal eliminativism, I applied to his solution for the paradoxes of de re modalities’ . Because of its vital role to figure out how dispositions are encountered by Quine, it was significantly noted that the realm of de re modalities doesn’t include contingent and impossible inferences about things. Therefore, for him, (...) all the intrinsic forces and elements of entities such as powers and causal or teleological dispositions for ontology demand to be seen necessarily as bound variables from a monist perspective. Although his denial of analyticity and the elimination of dispositional field of ontology, S. Mumford criticizes the monist perspective of Quine’s paradoxical approach to superveniences. Because superveniences create problems while determining type-type identities from a monist mereological perspective. It is observed that Quine faces with a reduction again in terms of his dispositional monism despite his critiques to repulse vagueness from the ontology in his well-known article Two Dogmas of Empiricism. -/- . The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology further (...) and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. I argue that legitimacy discourses serve a gatekeeping function. They give practitioners telic standards for riding herd on social practices, ensuring that minimally acceptable versions of the practice are implemented. Such a function is a necessary part of implementing formalized social practices, especially including law. This gatekeeping account shows that political philosophers have misunderstood legitimacy; it is not secondary to justice and only necessary because we cannot agree about justice. Instead, it is a necessary feature of actual human social practices, (...) which must be implemented via practitioners' discretion in changing contexts. (shrink)
